KMU slams torture of security guard mistaken for CPP leader

Labor center Kilusang Mayo Uno slammed today the illegal arrest, illegal detention and torture by the military of a security guard who was mistaken for a Communist Party regional leader, calling on the public to condemn the continuing violations of human rights under the Aquino government.

KMU condemned the torture of Rolly Panesa, a security guard employed by Megaforce Security, who was abducted by elements of the Philippine Army's 2nd Infantry Division last October 5 thinking that he is one Benjamin Mendoza, allegedly the leader of the Communist Party of the Philippines' Southern Tagalog unit.

A medical examination conducted on Panesa by the Health Action for Human Rights, which matched the Philippine National Police's medico-legal examination, indicates that he was tortured by the military.

"Panesa's case clearly shows that the Aquino government continues to employ torture, despite the passage of anti-torture legislation. It hammers home the point that grave violations of human rights continue under the Aquino government," said Elmer "Bong" Labog, KMU chairperson.

"This incident shows just how painful, if not deadly, cases of mistaken identity can be under the government's anti-insurgency program Oplan Bayanihan. It shows that even ordinary citizens and workers are not secure from grave human rights violations," he added.

"We are calling for justice for Panesa and his family. We are calling on the public to condemn the Aquino government and the military for what happened to Panesa and for continuing human rights violations in the country," he said.

KMU said that what happened to Panesa bodes ill for the peace talks between the Government of the Republic of the
Philippines and the National Democratic Front of the Philippines.

"What happened to Panesa shows just how the military treats persons suspected of being CPP leaders. It is consistent with how the GPH treated NDFP consultants in the past," Labog said.

"What happened to Panesa clearly shows that the Aquino government is sabotaging peace talks with the NDFP. The GPH continues to illegally abduct, illegally detain and torture allaged CPP leaders who may be NDFP consultants despite the NDFP's protests," he added.
